General Terms and Conditions – Kraamzorg Moederkracht B.V. (in formation)
Article 1 – Definitions
Kraamzorg Moederkracht: Kraamzorg Moederkracht B.V. (in formation), established in the Netherlands.
Client: a natural person receiving maternity care.
Care Agreement: the agreement between Kraamzorg Moederkracht and the client.
Care Provider: the maternity care assistant acting on behalf of Kraamzorg Moederkracht.
Overnight Maternity Care: additional maternity care outside regular hours.
Article 2 – Applicability
These terms and conditions apply to all offers, care agreements, and care services provided by Kraamzorg Moederkracht. Deviations are only valid if agreed in writing.
Article 3 – Formation of the Care Agreement
The agreement is concluded after:
written/digital registration;
acceptance by Kraamzorg Moederkracht; and
confirmation of care.
Article 4 – Provision of Care
Kraamzorg Moederkracht provides care:
professionally and in accordance with the indicated hours/entitlement; and
in compliance with applicable laws and regulations.
Scheduling depends on the indicated hours and availability. In case of illness or force majeure, substitute care may be arranged.
Article 5 – Client Obligations
The client must:
provide complete and correct information;
ensure a safe environment; and
cooperate with the care provided.
Unsafe circumstances may lead to suspension or termination of care.
Article 6 – Payment
Costs of maternity care are billed directly to the health insurer.
The deductible is billed by your insurance company. It costs €5.70 per hour.
Maternity care packages and additional products are invoiced directly by Kraamzorg Moederkracht; payment is due within 14 days.
Overnight Maternity Care: full prepayment is required; without payment, the service will not be provided.
Late payment results in statutory interest and collection costs.
Cancellation of Overnight Maternity Care:
Up to 48 hours in advance: free of charge
Within 48 hours: 50% payable
Within 24 hours or no-show/non-use: 100% payable
Article 7 – Liability
Liability applies only to direct damage caused by a demonstrable failure to perform.
Liability is limited to the amount covered by insurance.
No liability for indirect or consequential damage.
Article 8 – Force Majeure
Force majeure includes illness, emergencies, and unforeseen circumstances.
Kraamzorg Moederkracht may arrange substitute care.
Article 9 – Complaints Procedure
Complaints must be submitted in writing; confirmation of receipt will be provided within 5 working days.
If not satisfied, the client may turn to a recognized dispute resolution body in accordance with the Wkkgz.
Privacy complaints may be submitted to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
Article 10 – Applicable Law
Dutch law applies.
Disputes will be submitted to the competent court in the Netherlands.
